HUD Issues Rule Protecting Tenants Facing Evictions for Nonpayment of Rent in HUD-Assisted Properties

An interim final rule published in the Federal Register on October 4 prohibits the eviction of tenants for nonpayment of rent from HUD-subsidized properties and certain PBRA properties without providing a 30-day notice that includes information about available federal emergency rental assistance. New Public Housing Resources and Training Available

New resources and training are available on the HUD Exchange to support PHAs and their partners in developing and administering their public housing and voucher programs. These include the “Minimum Rent and Hardship Exemption Policy” video; video interviews with residents and staff about Mainstream vouchers; the “Introduction to Child Welfare” webinar recording; a five-part webinar on improving performance on your PHAS; the “PHA Asset Repositioning Post-Closing How-To” video; and a webinar series on financial management and best practices for HCV. HUD Extends NSPIRE Physical Inspection Pilot to 2023

In a Federal Register notice on September 28, HUD announced the extension of NSPIRE to April 30, 2023. The purpose of the NSPIRE pilot is to change the 20-year-old REAC physical inspection system to better reflect the condition of privately owned, HUD-subsidized housing. Read article

We would like to highlight two more winners of the 2021 NMA Housing Awards—our Resident Service awardees—as well as one other agency whose work impressed us.

East Baton Rouge Parish, LA steps up

For one southern city, last year, during the height of the pandemic, necessity was the mother of invention.

The idea for the Beds for Babies/Beds for Kids program began when a member of the E. Baton Rouge Parish Housing Authority maintenance team noticed children’s bedrooms without beds and asked if he could purchase the wood and supplies to build a bed for these children. This problem of infants and young children sleeping on the floor or co-sleeping with parents and siblings was elevated to Director J. Daniels and the entire staff of the EBRPHA. Turns out under the financial stress of COVID-19 some new parents were struggling to buy these pricey items.

Director Daniels and his team found that 50 children had been sleeping with their parents, on sofas or pallets.

Three most common mistakes to avoid in Multifamily Housing Enterprise Income Verification (EIV)

Unlike other programs, Multifamily Housing Enterprise Income Verification (EIV) doesn’t allow you to write your own rules; instead, you must follow official guidelines to the letter, every time. A mistake is worth potentially millions of lost dollars: Any violation will result in HUD taking 5% of the total property’s voucher for the month following, then for each month thereafter until the violation is cured.

Calculating a family’s rent can be tricky when a family receives cash contributions and other gifts from or when they receive income sporadically or from different sources. For the Multifamily program, the HUD Handbook 4350.3 (REV-1) provides some guidance which NMA trainer and consultant Reneé McTyeire discusses here. (Note, this guidance does not apply to programs under HUD’s Office of Public and Indian Housing (PIH) programs).
