HUD Issues Enforcement Guidance on Emotional Support Animals

FHEO announced in a memorandum that going forward, for complaints related to animal-related reasonable accommodations, FHEO will find reasonable cause and recommend charges only for cases involving animals trained to provide disability-related assistance, using the training component of the ADA definition of a service animal. Practically, this means that HUD will be unlikely to pursue enforcement action on complaints involving untrained emotional support animals, while individuals retain the right to pursue action regarding reasonable accommodation requests under the Fair Housing Act.
